How to Transfer the Ownership of a Patent in China?

Recently we have a overseas client want to change the ownership of a patent to another person. Generally speaking, the procedure of a patent transfer could be divided into following steps:

How to Transfer the Ownership of a Patent in China

Firstly, you need to choose a specific way to launch a patent transaction for selling the patent ownership. For example, publishing a sale on patent-related websites or selling the patent ownership via the professional agencies.

Secondly, the assignors (the ones transferring away patent ownership) and the assignee (the ones receiving the rights) need to sign a patent assignment or a contract of transferring patent ownership, which is one of the most important steps for Patent Transfer.

In the next step, relevant materials and documents of this patent transfer need to be prepared and then submitted to the China National Intellectual Property Administration (CNIPA) via a professional agency, including the said patent assignment or contract of transferring patent ownership and an application paper. (the application paper should be downloaded from the official website of CNIPA. Here is the site address:http://www.cnipa.gov.cn/bgxz/index.htm )

After accomplishing the steps mentioned above, you need to wait approximately 2 or 3 months for the results of the application of transferring the ownership of the patent form CNIPA.
