How to Check whether Chinese Suppliers are Qualified to Export Medical Products?

Nowadays, there is a large number of international trade in purchasing medical products from China, and the commercial disputes caused by the substandard quality of goods also increase. Therefore, it is very important for the buyer to verify whether the supplier is qualified to produce and export medical products before placing an order.

How to verify it? The following are the verification steps we summarized after handling a lot of cases.

First, we will verify whether the supplier is a legally registered entity in China in the PRC National Enterprise Credit Information Publicity System (国家企业信用信息公示系统), so as to confirm whether the opposite party of the sales contract is a real existing and operating entity, and confirm its real name, legal representative, unified social credit code and address. The above information will play an important role in drafting the sales contract and recovering compensation when disputes arise.

Second, we will verify whether the supplier has an export license on Credit Publicity Platform of Import and Export Business of Customs of the PRC (中国海关企业进出口信用信息公示平台). If the supplier does not have an export license, the medical products produced and sold by the supplier cannot pass through the Chinese Customs even if they are legally registered and meet the standards stipulated by the buyer's country.

Third, we will verify whether the medical products exported by the supplier have been legally registered in China, and whether the supplier has legally registered in China for its production and sales on the official website of the PRC National Medical Products Administration (国家药品监督管理局). Only with the above registration can the supplier legally produce and sell medical products. Otherwise, it is likely that the goods will do not meet the agreed standards and be detained by the customs in the transaction.

Fourth, we will verify the authenticity and validity of the test reports of the medical products provided by the supplier on the official websites of China National Accreditation Service for Conformity Assessment, European Commission and the US Food & Drug Administration, so as to confirm whether the medical products meet the standards agreed in the sales contract.
