China's New Regulations on Export of Medical Products
As the novel coronavirus pneumonia outbreak has become more severe around the world, the international trade of medical supplies for epidemic prevention is gradually important, especially the export of medical devices and products made in China, a big manufacturing country.
In order to fix the present mess in the area of exporting medical supplies made in China for epidemic prevention, Ministry of Commerce of the People's Republic of China, General Administration of Customs, P.R.China and National Medical Products Administration (hereinafter the “NMPA”) issued the Announcement on the Orderly Export of Medical Products (hereinafter the “Announcement”) (关于有序开展医疗物资出口的公告) on March 31, 2020. According to the Announcement, companies exporting 2019-nCoV detection reagents, surgical masks, medical protective clothing, respirators and infrared thermometers in China must have obtained registration certificates of medical devices or products, which means the medical products are already registered with the NMPA.
In previous research, in accordance with the Regulation on the Supervision and Administration of Medical Devices (医疗器械监督管理条例) issued by the State Council of China, Chinese lawyers in Landing Law Office have verified that medical products such as surgical masks and medical protective clothing exported by companies in China must be registered with the NMPA, which means the Announcement should be regarded as a re-emphasis on the above regulation. Therefore, you need to pay special attention to check if the company has obtained registration certificates of medical devices or products before purchasing above-mentioned medical products from a company in China, otherwise there will be a risk that the purchased medical products will be detained, returned or destroyed by China Customs, which will ultimately damage your interests.
