What Should Your Employer Do When You Left Your Job in China: Advise from Chinese Lawyer


Materials required for the cancellation of Foreigner’s Work Permit


According to the Guidelines on Work Permit Services for Foreigners in China (Interim) issued by the State Bureau of Foreign Experts, Articles 21 and 24 of the Regulations on Employment Management for Foreigners in China issued by the Ministry of Human Resources and Social Security, and the telegrams to the Shenzhen Science and Technology Innovation Commission and the Ningxia Hui Autonomous Region Bureau of Foreign Experts Record of telephone interview, after the termination of the labor contract between a foreign employee and a Chinese employer, the former employer of the foreign employee shall submit to the local Bureau of Foreign Experts an application for the cancellation of the work permit of the foreign employee. The materials required for the application for the cancellation of the work permit include:

1. Application Form for Cancellation of Foreigners Work Permit. Remarks: Fill in and print online, cover the official seal of the employer and upload it to the Service System for Foreigners Working in China.


2. Certificate of termination of employment relationship, certificate of termination of contract or other certification materials related to the reasons for cancellation. Remarks: The above materials should be original. The certification materials for termination of employment relationship and termination of contract should be signed by both parties.


3. Original Foreigner’s Work Permit.


4. Original Residence Permit of Foreigners.


Except that the Application Form for Cancellation of Foreigners Work Permit shall be submitted on the line of the Service System for Foreigners Working in China, all other materials shall be submitted by the original employer of the foreign employee when the application for cancellation of work permit is processed on the spot by the local Bureau of Foreign Experts.
